YOUR PRIVACY IS IMPORTANT TO US. PLEASE READ THIS PRIVACY POLICY TO LEARN ABOUT THE INFORMATION THAT OPENPROPERTY COLLECTS FROM YOU AND HOW OPENPROPERTY USES THAT INFORMATION.

This Privacy Policy applies to OpenProperty.com ("Site") and any related website or mobile applications on or to which this Privacy Policy is linked or referenced (collectively, the "Services"). The Services are operated by 1st Financial Funding & Investment Corporation d/b/a OpenProperty ("OpenProperty," "we," "us" or "our").

  1. SCOPE

    This Privacy Policy describes the information we collect through the Services and why we collect it and what we do with the information we collect. This Privacy Policy does not apply to information that is collected by any third-party websites or services that you may access through the Services.

    Our agreements with certain customers may contain provisions about the collection, use, storage and disposal of information collected through the Services and offline. If a provision of a customer agreement conflicts or otherwise is inconsistent with a provision of this Privacy Policy, then the provision of the customer agreement will prevail but solely to the extent of the conflict or inconsistency.

    This Privacy Policy is incorporated into the OpenProperty Website Terms of Use and the OpenProperty Terms and Conditions.

  2. INFORMATION WE COLLECT

    OpenProperty collects two types of information: Personal Data and Usage Data.

    Personal Data is information that directly or indirectly identifies a specific person, such as name, email address or mailing address.

    Usage Data is information that, by itself, does not individually identify a specific person, such as browser type and operating system. For OP Residents (as defined in the OpenProperty Terms and Conditions), Usage Data may include the highest amount of rent you paid during a tenancy, the security deposit you paid and other non-identifying information about a tenancy.

    OpenProperty generally does not treat Usage Data as Personal Data. We may, however, link together different types of Usage Data or link Usage Data to Personal Data. If linked information identifies (or can be used to identify) an individual person, OpenProperty treats the linked information as Personal Data.

  3. HOW WE COLLECT INFORMATION

    How and what information OpenProperty collects depends on how and why the Services are used.

    OpenProperty collects information in the following ways:

    • When You Provide Information to OpenProperty: Certain Services require you to provide information before you can use them. For example, OP Residents must create an account before using certain Services. When you create an account, we ask you for Personal Data, such as your name, email address, telephone number, date of birth and rental information. If you send an email to support@openproperty.com, we collect the email address that you use to contact us. We also collect feedback, questions and information that you provide to us for customer support.

      When You Use the Services: We collect information about the Services that you use and how you use them:

      • Through Server Logs: A server log is a list of the activities that a server performs. OpenProperty's servers automatically collect and store in server logs your search queries, Internet Protocol (IP) address, hardware settings, browser type, browser language, the date and time of your request and referral URL and certain cookies that identify your browser or OpenProperty account.

      • From Your Computer or Mobile Device: We collect device-specific information, such as your computer or mobile telephone model, operating system version, device identifiers and mobile network information. If you have an OpenProperty account, OpenProperty may link your device information with your account.

      From Other Sources: OpenProperty collects information from third parties, specifically:

      • Through Service Providers: Third parties may from time to time assist us with our business operations. As part of their services, they may collect and use information (including Personal Data and Usage Data) through the Services and share the collected information with us. For example, our service providers collect and share information with us to analyze the performance of the Services, detect and prevent fraud or to improve user experience.

      • When you Connect with Social Media through the Services: Certain Services may link with social media platforms and social media plug-ins (e.g., the Facebook "Like" button, "Share to Twitter" button) (collectively, "Social Media"). When you connect using your Social Media accounts, we may collect the Personal Data that provided to that Social Media service provider. Please review the privacy disclosures for your Social Media account to learn more about how Social Media account information is collected and shared with us.

  4. DATA COLLECTION TECHNOLOGY

    We use data collection technology to collect information about you and your use of the Services.

    Data collection technology deployed through the Services includes cookies and web beacons.

    • A cookie is a small text file that is sent to or accessed from your web browser or your computer's hard drive. A cookie typically contains the name of the domain (internet location) from which the cookie originated, the "lifetime" of the cookie (i.e., when it expires) and a randomly generated unique number or similar identifier. A cookie also may contain information about your computer, such as user settings, browsing history and activities conducted while using the Services. A web beacon (also called a pixel tag or clear GIF) is a piece of computer code that enables us to monitor user activity and website traffic.     Data collection technology facilitates your access to the Services by, for example, storing your password so you do not have to reenter it each time you use the Services. Data collection technology also helps improve functionality and determine which features users prefer by collecting information about your browser type, domain name of your Internet service provider, websites visited before and after visiting the Services and web pages viewed. We compile statistics about use of the Services to help us analyze technical and navigational information about the Services and to detect and prevent fraud.

    The Services use the following cookies:

    • Strictly necessary cookies, which are required for the operation of the Services. Without them, for example, you would not be able to register or log in to your OpenProperty account.

    • Analytics cookies, which allow OpenProperty to recognize and count the number of visitors, learn how visitors navigate the Services and improve the Services.

    • Functionality cookies, which OpenProperty uses to recognize you when you return to the Services.

    • Interaction cookies, which allow you to recommend OpenProperty on Social Media.

    OpenProperty also uses analytics services to collect Usage Data, such Webtrends (see https://www.webtrends.com/terms-policies/privacy/privacy-statement/). Generally, analytics services do not identify individual users. Many analytics services allow you to opt out of data collection.

    Your Control of Cookies: Some web browsers (including some mobile web browsers) provide settings that allow you to control or reject cookies or to alert you when a cookie is placed on your device. You also may be able to reject mobile device identifiers by activating the appropriate setting on your mobile device. Although you are not required to accept cookies or mobile device identifiers, if you block or reject them, you may not have access to all features available through the Services.

    Do Not Track: Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) incorporate a "Do Not Track" ("DNT") or similar feature that signals to websites that a user does not want to have his or her online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about the browser's user. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, many website operators, including OpenProperty, do not respond to DNT signals.

  5. HOW WE USE AND SHARE YOUR INFORMATION

    OpenProperty uses Personal Data to make the Services available for you, to improve the Services, to develop new products and to operate our businesses.

    OpenProperty shares Personal Data collected through the Services as follows:

    • Affiliates: OpenProperty shares Personal Data within OpenProperty's corporate family for the purposes described in this Privacy Policy and as required or permitted by law.

    • Service Providers: OpenProperty shares information with OpenProperty's distributors and suppliers and third-party service providers that help us operate the Services. OpenProperty enters into written agreements with each service provider that requires the service provider to protect your Personal Information.

    • Corporate Transactions: OpenProperty may share and transfer Personal Data if OpenProperty is involved in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control by OpenProperty or its parent or affiliated companies (in each case, whether in whole or in part).

    • Other Lawful Disclosures: OpenProperty also shares information: (i) as required or permitted by law; (ii) if we determine that disclosure of specific information is necessary to comply with the request of a law enforcement or regulatory agency or other legal process; (iii) to protect the rights, privacy, property, interests or safety of Open Property or our affiliated companies, customers, employees or the general public; (iv) to pursue available remedies or limit damages; (v) to enforce OpenProperty's agreements with you; and (vi) to respond to an emergency.

  6. HOW WE PROTECT AND STORE INFORMATION

    OpenProperty cannot guarantee the privacy or security of information transmitted to or through the Services.

    OpenProperty deploys administrative, physical and technical safeguards intended to help protect information that we collect, process and store. Unfortunately, however, no safeguards or electronic data transmission are completely secure. Any transmission is at your own risk and OpenProperty expects that you will use appropriate security measures to protect your information.

    You are responsible for maintaining the security of your account credentials and other authentication involved in obtaining access to password-protected or secure areas of the Services. OpenProperty will treat access to the Services through your account credentials as authorized by you. Unauthorized access to password-protected or secure areas is prohibited and may lead to criminal prosecution.

    We may suspend your use of all or part of the Services without notice if we suspect or detect any breach of security. If you believe that information you provided to us is no longer secure, please notify us immediately using the contact information provided below.

    We store and retain information for as long as necessary to fulfill the purposes for which you provided the information, to comply with legal obligations, to resolve disputes, to enforce our agreements with you and for similar essential purposes.

  7. FAIR CREDIT REPORTING ACT

    Certain OpenProperty Services are regulated by the federal Fair Credit Reporting Act (FCRA) and companion state laws.

    OpenProperty is a nationwide specialty consumer report agency under the Fair Credit Reporting Act (FCRA). The FCRA promotes the accuracy, fairness, and privacy of information in the files of consumer reporting agencies. OP Residents (as defined in the OpenProperty Terms and Conditions) may obtain copies of their OpenProperty profiles online any time.   8. CHILDREN'S PRIVACY

    The Services are intended for use by adults only.

    The Services are not directed to or intended for use by minors. Consistent with the requirements of the U.S. Children's Online Privacy Protection Act, if we learn that we received any information directly from a child under age 13 without his or her parent's verified consent, we will use that information only to inform the child (or his or her parent or legal guardian) that he or she cannot use the Services.

  9. CALIFORNIA RESIDENTS

    California Code Section 1798.83 permits individual California residents to opt out of OpenProperty's disclosure of Personal Data to third parties for their direct marketing purposes. California law also permits residents of California to request and obtain from us once per year, free of charge, a list of the third parties (if any) to whom we have disclosed Personal Data for their direct marketing purposes in the prior calendar year, as well as the type of Personal Data disclosed to those third parties. Please note, however, that Open Property does not disclose your Personal Data to third parties for their direct marketing purposes.

  10. LINKS TO OTHER WEBSITES AND SERVICES

    OpenProperty is not responsible for the information collection practices of websites and services that are not operated by us, even if the Services include a link to them.

    The Services may include links to third-party websites and services that are not operated by us. When you click these links, you are navigating away from the Services. A link to a third-party website or digital service does not mean that we endorse it or the quality or accuracy of information presented on it. If you decide to visit a third-party website or digital service, you are subject to its privacy practices and policies, not ours. This Privacy Policy does not apply to any Personal Data that you provide to these other websites and services.

    We also may from time to time offer services that are co-branded (i.e., operated in partnership with an unaffiliated business). We and our co-branding partner may collect Personal Data on co-branded websites or services. Our processing of your Personal Data is subject to this Privacy Policy but the processing of your Personal Data by our co-branding partner is subject to its privacy policy and practices, not ours.

  11. NOTICE TO INTERNATIONAL VISITORS

    The Services are intended for U.S. residents only.

    OpenProperty is headquartered in the United States and the Services are controlled and operated from the United States. If you are using the Services from outside of the United States, you do so at your own risk and you are solely responsible for compliance with local laws.

  12. CHANGES TO THIS PRIVACY POLICY

    OpenProperty reserves the right to change this Privacy Policy. If OpenProperty makes material changes to the way we use Personal Data, OpenProperty will post a notice about the changes in the Services.

    The Effective Date of this Privacy Policy is set forth at the top of this webpage. We reserve the right to change our Privacy Policy as business needs or applicable law require. If OpenProperty makes material changes to the way we use Personal Data, OpenProperty will (unless otherwise required by law) take steps to notify you before the changes take effect. Your continued use of the Services after the Effective Date of the revised Privacy Policy constitutes your acceptance of the revised Privacy Policy. The revised Privacy Policy replaces and supersedes all previous versions.
